Suspicious Calls by a Referee Last Night is Drawing Serious Concerns

Throughout the past week there has been several controversial calls throughout the National Hockey League, including over three in the Toronto Maple Leafs game and a few during the Colorado Avalanche vs Dallas Stars.
Well, when the Dallas Stars faced off against the Colorado once again last night, the Avalanche dominated in a amazing fashion and won by a score of 4-1, but something else went noticed during the game.
A Colorado Avalanche player went down after taking a stick directly to his face, in quite the hard manner, it was clearly a penalty and it is called a penalty 99% of the time.
This instance fell in the 1% of the time, and no, not because the referee did not notice it.. it fell into the 1% of not being a penalty due to a made up rule, which was said for the first time ever and is drawing concerns to the officiating.
The referee stated the following:
''The play was killed due to an injury. There is no injury, no penalty.''
No injury, so no penalty? That is the first i hear of that EVER, Colorado fans and even the coach were left in disbelief, all they could do was smile as that's something that has never been said.
A high stick is a high stick, regardless if a player is injured or not, a players stick should not be at a players heads height, therefor a penalty is always called.
What were these refs thinking!?
