Update on the case against Sean Higgins who killed Johnny and Matthew Gaudreau takes a turn

Prior to the beginning of the regular NHL season, in August we were subject to the passing of Johnny and Matthew Gaudreau. Thanks to analleged drunk driver, in Salem, New Jersey, they passed before their time.

Since then, the hockey world has been reeling from the loss of anicon, and the hockey family that everyone's supported during this tragedy.

Since then in late August, the plaintiff in the trial Sean Higgins has been held without bail. He hasn't had a pre-trial hearing yet, but development has been slow in the case of the Gaudreau Brothers.

This is troubling, considering there's been testimony that Sean Higgins had 6 alcoholic drinks before getting behind the wheel that day.

Authorities say Higgins of Woodstown, New Jersey, was impaired after he drank five or six beers on the day he drove into the brothers' bicycles and that he has a history of road rage and aggressive driving.

At the time of the accident, he had been talking on the phone with his friend, after having a conversation with his mother that upset him.

A driver who was in front of Higgins told police that Higgins had been driving aggressively. When she and the vehicle ahead of her slowed down and moved left to go around the cyclists, Higgins sped up and veered right, striking the Gaudreaus, she said.

Higgins had a blood-alcohol level of .087, which is above the state's .08 legal limit, and he failed a field sobriety test, police said. He faces preliminary charges of two counts of death by auto, reckless driving, possession of an open container and consuming alcohol in a vehicle.

Higgins faces the Gaudreau

In an update, Higgins finally had a pre-trial hearing and was present in court for the first time. Instead of prior hearings being virtual, he would have to face the Gaudreau family who were present in the courtroom.

The Gaudreaus were silent during the entire hearing, and according to sources, there wasn't a plea deal offered to the defendant.

There are reports that while the court is still in discovery, they'll place a 30-day delay, while the New Jersey State Police do their work.

This process is slow, with purpose but we feel for the pain that the Gaudreau family must be going through at this point in time.
